34-year-old Owen Sound man charged with manslaughter

An Owen Sound man has been charged with manslaughter after the death of an Owen Sound businessman died after what police believe may have been an "altercation" Monday night.
James MORELLI, 34, has been remanded in custody pending a bail hearing today. He was charged after William "Larry" HILSDEN was found unconsciious in a downtown parking lot Monday night.
Two people were originally taken into custody Tuesday, but one was later released.
Chief Tom KAYE of the Owen Sound Police Services said earlier Tuesday, before any charges had been laid, that police were " investigating it as though there were foul play involved, but to what extent that is, we don't know."
Yellow crime scene tape cordoned off a large section of the municipal parking lot behind the Golden Sand restaurant, formerly the Ritz Cafe, on Tuesday.
Const. Chantelle BEIRNES of the Mount Forest-based Ontario Provincial Police Forensic Identification Unit and acting Capt. Greg SCOTT of Owen Sound Fire and Emergency Services filmed the lot from an aerial fire truck.
James MORTON lives in an apartment above the restaurant. He said in an interview he was returning from a walk Monday night when he saw two men in the parking lot. One was lying on the ground next to the open driver's door of a truck, his legs under the vehicle.
"I thought the other guy had beat him up or something," MORTON said, "but he said, 'I found him like this and I can't get a pulse.' I tried and I couldn't get one either."
MORTON said the first man called 911. Emergency services worked on the unconscious man for some time before moving him to the Owen Sound hospital, where he was pronounced dead.
The cause of death was not released by police and hospital staff declined to provide that information. Police said in a news release Tuesday night an autopsy will be performed in London on Thursday.
Darlene NELSON, a server at the Golden Sand restaurant, said HILSDEN was a regular customer at the restaurant, eating there between five and seven days a week.
"He was my landlord for six years and I love him dearly," NELSON said.
She said HILSDEN, 61, ate a late meal Monday and left through the rear entrance at about 10 p.m. According to a news release from the city police, he was found unconscious approximately 30 minutes later in the parking lot.
Few other details have been released but acting Staff Sgt. Vince WURFEL said in the news release police would like to speak to anyone who "may have witnessed an altercation in the municipal parking lot in the 900 block of 3rd Avenue East."

HILSDEN owned a number of residential properties and businesses in and near Owen Sound over the years. They included a restaurant along the East Bayshore Road, a downtown home electronics store called Hilsden Sight and Sound and the Ted and Grace's snack bar at the corner of 2nd Avenue and 14th Street West. He was in the process of rebuilding Ted and Grace's after a 2004 fire gutted the landmark.
"He was always a good employer to work for," said Jamie JOHNSTON, who worked for several years at Hilsden Sight and Sound. "He always treated us good… even when times were tough, he always made sure I got paid."
HILSDEN's brother, Ronald HILSDEN, said Tuesday the family did not wish to comment.

Two drown after falling through ice
Cellphone, candles save one man's life

A 22-year-old Barrie man who fell off the back of a dirt bike as it plunged into Lake Simcoe early Sunday morning pulled himself out of the water and used his cellphone to call 911.
He then sat on the ice for about four hours, waiting for help.
His two Friends who were driving the bikes when they hit a four-foot pressure crack in the ice at about 4 a.m., however, drowned in the deep water between Snake Island and Fox Island.
“I think he was just a little closer to the ice when they went in, and he was able to scramble out,” said York Regional Police Det. Rod RAMAGE.
The man, who was travelling with a survivor kit including a flashlight, candles and a cellphone wrapped in plastic inside his backpack, lit a fire on the ice to keep warm while waiting for rescue workers.
He was found by Innisfil firefighters at about 7: 45 a.m. and transported to shore in an air boat.
He was treated at Royal Victoria Hospital in Barrie for hypothermia, and police said “he'll be perfectly Okay.&rdquo
Emergency crews searched the lake near Innisfil unsuccessfully for about four hours, struggling to locate the man.
“Phone reception in the area wasn't that good and he didn't know exactly where he was,” South Simcoe Police Sgt. Brian MILLER said. “It was pretty dark out there and difficult to find him.&rdquo
The bodies of the other men were recovered by York Regional Police divers at about 3: 30 p.m., and identified as Brian DWYER, 22, of Innisfil and Randal HILTS, 22, of Bradford.
Police said the men left an Innisfil home at about 3 a.m., eventually venturing out across the ice after “joy-riding” along the shoreline.
“The surviving witness was uncertain where they went out onto the ice because they had been riding up and down the shore area for quite a while,” said Det. RAMAGE.
Riding motocross motorcycles without headlights, RAMAGE said the three “were doing the typical things that 22-year-old boys do when they get out on their motorcycles in an area where they don't have to worry about other vehicles.
“They were all over hill and dale,” RAMAGE said.
“It is my understanding they were doing their motocross activities in around the shore, on and off the ice in the shallow area, for about an hour before they decided to head across the lake.&rdquo
The trio of Friends was riding tandem across thin ice between Fox Island and Snake Island when their vehicles went into open water, police said.
They were “going for a drive around the area there, and had no specific plan to go anywhere.&rdquo
Investigators cautioned residents not to drive onto unsafe ice.
“You have to be aware of the conditions that exist and the thickness of the ice and if you're not familiar, don't go out,” York Regional Police Inspector Norn MILES cautioned. “Unfortunately, we've had a lot of these incidents over the years and they're tragic for everyone.&rdquo
Onlookers gathered at the shore off Innisfil Beach Park, straining to watch rescue efforts happening a few kilometers out in the lake.
“It's too bad; you hate to see it,” Bill ANDREWS said. “Probably young guys doing something foolish.&rdquo
Police said alcohol may have been a factor in the drownings.
Ice conditions in the area are described as unsafe because of recent warm temperatures and rain. A steady downpour drenched rescuers and those who watched from shore Sunday, as water pooled on the lake, turning ice into slush.
“I wouldn't go out there for anything right now,” ANDREWS said, shaking his head. “Just look at the conditions.&rdquo

Innisfil, Ontario -- An Innisfil man spent four terrifying hours drifting on Lake Simcoe's treacherous ice overnight yesterday after the two Friends he was with plunged through a pressure crack on their motorcycles and drowned.
The 22-year-old survivor struggled to light candles and use a flashlight and keep in touch with police using the cellphone he'd brought along in an emergency survival pack, but rescuers said it was nip and tuck.
"Phone reception in the area wasn't that good and he didn't know exactly where he was," South Simcoe Police Sgt. Brian MILLER said, speaking of the challenge facing rescuers in locating the man.
"It was dark and difficult."
Police said they were not sure if the survivor, a passenger on one of the bikes, managed to jump off as it hit the metre-wide pressure crack in the ice at about 4 a.m. He might have climbed out of the water.
The drivers -- Brian DWYER, 22, of Innisfil and Randal HILTS, 22, of Bradford -- went down with their bikes and drowned in the deep water between Snake Island and Fox Island. Their bodies were later recovered by York Regional Police divers.
Police and fire officials have cautioned residents to stay off the ice on area lakes and rivers, especially with the region's recent cycles of thaws and freezes.
"You have to be aware of the conditions that exist and the thickness of the ice and if you're not familiar, don't go out," York Regional Police Insp. Norn MILES cautioned. "Unfortunately, we've had a lot of these incidents over the years and they're tragic for everyone."

Richard was a Stationary Engineer at International Truck and Engine for 37½ years, retiring in 1985 due to ill health. The passing of Kimberley Ann HILTZ of Fredericton, New Brunswick, wife of Chris GIBSON, occurred peacefully at their home on Thursday, November 23rd, 2006. Born on April 20th, 1973 in Fredericton, New Brunswick, Kim is the daughter of Peter and Patricia HILTZ. Kim is also survived by one sister Tammy MEHAN (HILTZ,) brother-in-law Jim MEHAN, one niece Mackenzie MEHAN, and two nephews, Jacob MEHAN and Joshua MEHAN, all from Saint John, New Brunswick. After graduating from University of New Brunswick in Fredericton and gaining experience with Fundy Cable, Kim moved to Toronto to launch her successful marketing career with Rogers and to begin her new life with Chris. Kim's zest for life and commitment to experience all that life has to offer afforded Kim many opportunities to travel worldwide with her husband and members of her family. Kim knew the meaning of life and lived life that way. Kim's commitment to her family, which included her devotion to her precious Golden Retriever, Hope, was an inspiration to all who knew her. Visitation will take place at McAdam's Select Community Funeral Home at 160 York Street in Fredericton on Saturday afternoon 2-4 p.m. and 7-9 p.m. and on Sunday afternoon 2-5 p.m. Mass of Christian Burial will be held at St. Dunstan's Catholic Church on Regent Street on Monday, November 27th, 2006 at 12: 00 noon with Rev. Bill Brennan as Celebrant. Reception will follow at the Monsignor Boyd Family Centre at 120 Regent St. For those who wish, in lieu of flowers, Kim has requested that donations be made to the Cruelty Division of the New Brunswick Society for the Prevention of Cruelty to Animals, P.O. Peacefully with family by her side on Thursday, April 13th, 2006 at Southlake Regional Hospital, in her 89th year. Predeceased by her beloved husband Reginald. Margaret is survived by her loving daughter Catherine. She will be remembered by her grandchildren Christopher (Jennifer), Lisa (Scott), Joey (Kerri) and Justin, and great-grandchildren Chloe, Leah and Dylan. Former member of Donminster and Eastminster churches, and an active volunteer at Scarborough Grace Hospital. Friends will be received at the Dixon-Garland Funeral Home, 166 Main St. N. (Markham Road) on Tuesday, April 18th, 2006 from 11 a.m. until time of service at 1 p.m. held in the Chapel.
